These Terms of Service will confirm that you understand that you have met OneLoanPlace.com's ("OLP") prequalification guidelines. You understand and agree that:
    (i) OLP has relationships with multiple unsecured lending partners;
    (ii) we offer no guarantee that you will be approved by our recommended lending partner for all or part of the initial loan amount you requested;
    (iii) all decisions including, but not limited to, the loan's approval, amounts, interest rates, terms and disclosures will be offered directly to you by the lender partner, not OLP;
    (iv) the lending partner may offer you a fixed, closed-end or revolving loan;
    (v) OLP will provide your contact information to the lending partner who is then authorized to contact you;
    (vi) the lending partner may obtain your credit report to make a final decision; and
    (vii) the lending partner may share with OLP, to the extent permitted by law, certain information about you, your account and your credit experience with them.

You appoint OLP as your special and limited attorney in fact to represent you in the loan application and verification process, either electronically, verbally, written or otherwise. You agree to hold OLP harmless from any misstatements. You understand that depending upon the nature of your loan request, and other possible factors, financing may be approved in your personal and/or business name, and you agree that you will accept your loan proceeds as long as your approved loan terms are acceptable to you.

ACCOUNT CREATION

You may be given the opportunity to register via an online registration form to create a user account ("Your Account") that may allow you to receive information from OLP and/or to participate in certain features on the Site such as certain Interactive Areas. OLP will use the information you provide in accordance with the OLP Privacy Policy. By registering you represent and warrant that all information that you provide on the registration form is current, complete and accurate to the best of your knowledge. You agree to maintain and promptly update your registration information on the Site so that it remains current, complete and accurate. During the registration process, you may be required to choose a password and/or user name. You acknowledge and agree that OLP may rely on this password or user name to identify you. You shall be responsible for protecting the confidentiality of your user name(s) or password(s), if any. You are responsible for all use of Your Account, regardless of whether you authorized such access or use, and for ensuring that all use of Your Account complies fully with the provisions of these Terms of Service. (E) Equipment. You are responsible for obtaining and maintaining all connectivity, computer software, hardware and other equipment needed for access to and use of the Site and all charges related to the same.

By saving your information with OLP or by completing a loan inquiry you give OLP permission to retain all information you submitted for the prescribed State Specific Record Retention period and to make live, manually dialed, automatic dialed or pre-recorded calls, emails, direct mailing or other communication to discuss, provide or remind you of any information in relationship to your submission, including incomplete loan inquiry, the delivery of loan request matches, deadlines, quality of services or other matters in connection with your loan inquiry. For any service, you represent that all of the information you have provided in your submission and loan inquiry is true, accurate and complete to the best of your knowledge.
When you "submit" information, create an account or otherwise register for services through OLP and its Companies' website or otherwise, you hereby understand and agree that you have established a business relationship between you and OLP, which is the owner of this site. Accordingly, OLP and/or its Companies may send your information to its affiliates, Lending Partners/Partners as provided in the Privacy Policy. In addition, you agree that OLP may contact you using information you provided with information and offers of services available through OLP and the Website. You hereby provide express written consent to any such communication or phone calls even if your phone number is on any Do Not Call list, federal, state or corporate. You also agree that calls may be placed live, by automatic dialing, and/or by pre-recorded message. Charges may apply to a mobile phone if that is the number you provided. Communications may also be by email, direct mail, and/or text message.

If at any time you do not wish to continue to receive communications from OLP, its companies, or its affiliates, Lending Parnters you may modify your preferences by calling 1-888-242-5667 or by unsubscribing through any email sent by OLP.

INDEMNIFY

As a condition of use of the Websites and/or OLP's services, you agree to indemnify OLP and its Suppliers, Lending Partners, Affiliates and/or Providers against any and all liabilities, expenses (including attorneys' fees) and damages arising out of claims resulting from your use of the Websites, including without limitation any claims alleging facts that if true would constitute a breach by you of these Terms & Conditions

LIMITATION OF LIABILITY

YOU UNDERSTAND AND AGREE THAT OLP WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES RESULTING FROM OR IN ANY WAY CONNECTED TO YOUR ACCESS TO, USE, INABILITY TO USE, OR RELIANCE ON THE WEB SITE OR ANY PRODUCTS OR SERVICES OBTAINED THROUGH THE WEB SITE. NOTWITHSTANDING ANY OTHER PROVISION OF THESE TERMS OF USE, OLP'S ENTIRE LIABILITY TO YOU SHALL NOT EXCEED $1,000. FOR THOSE JURISDICTIONS THAT EITHER DO NOT ALLOW OR PLACE RESTRICTIONS UPON THE EXCLUSION OR LIMITATION OF DAMAGES IN CERTAIN TYPES OF AGREEMENTS, THIS LIMITATION SHALL BE CONSTRUED TO PERMIT THE MAXIMUM EXCLUSION OR LIMITATION PERMITTED BY APPLICABLE LAW.

DISCLOSURES

Depending on which lending partner is chosen for your particular situation, the following may apply: By submitting this application, you acknowledge and agree to the following: You are at least 18 years of age or at least 21 years of age if a permanent resident of Puerto Rico. Our ("Lending Partner(s)") may obtain a credit report about you from a creditreporting agency to process your application, service your account, and manage its relationship with you. The Lending Partner and/or its affiliates may share certain information regarding this application and account. The Lending Partner may also share with OLP and with others, to the extent permitted by law, certain information about you, your account and its credit seeking experience with you. Upon the opening of your account, you may choose to exempt the account from some of this information sharing. Your Account Agreement, which includes an arbitration provision, will govern your account relationship. You will be responsible for all charges incurred under the terms of your Account Agreement. If you have responded to any offer of credit from the Lender Partner in the past 30 days, this application may be considered a duplicate. So that the Lending Partner's credit analyst can make a decision, we must have your authorization to submit this application to the Lending Partner. By allowing us to proceed with your loan request, you agree to all of the disclosures above.

ACCEPTANCE

By clicking submit, you are allowing us to proceed with your loan request and you acknowledge you have read the above Terms of Service, Indemnity, Limitation of Liability and Disclosures and that you accept them in their entirety.

OPT-OUT

You may remove your information from our database. If you remove your information from our database it will no longer be used by us for secondary purposes, disclosed to third parties, or used by us or third parties to send promotional correspondence to you. You may remove your information by sending your request in writing via email to contactus@oneloanplace.net.
